The US Justice Department has entered the fray in a legal challenge brought forward by California Republicans, aiming to prevent the California's recently passed congressional redistricting map.
This court case, filed in federal court, targets the redistricting plan supported by Governor Gavin Newsom, which was created in reaction against a Republican-led gerrymander in Texas.
"California's redistricting scheme constitutes a brazen power grab that tramples on voting rights and undermines the electoral system," stated the US attorney general.
The Democratic party have expressed confidence that the redistricting plan will withstand legal scrutiny.
"These opponents lost at the ballot box and they are likely to face defeat in the judicial system," stated a spokesperson for Governor Newsom.
Legal Basis
The lawsuit claims that California's map improperly used racial considerations to heavily favor Latino communities in contravention of the US Constitution.
"Race cannot be used as a proxy to advance political interests, but that is exactly what the state legislature did with Proposition 50," stated a high-ranking representative from the Civil Rights Division.
Political Context
The legal battle represents the most significant response by the Democratic party in the continuing political battle that started with Texas and has spread across various parts of the country.
Unlike other states, where Republican state legislatures have implemented partisan maps, California's plan required voter approval, which it received with approximately two-thirds of the vote.
National Implications
Democrats need to flip just a small number of GOP-controlled House seats to take control of the chamber in next year's midterm election.
The political group controlling the majority will influence the remaining period of the current administration, determining whether a GOP-controlled legislature will continue to deliver its political program or encounter opposition, investigations and possible further challenges.
